Special Needs Law Month

We should not let October slip by without making note of National Special Needs Law Month.

In October, special needs planning attorneys throughout the country, like myself, work to educate people with special needs, along with their families, and caregivers about their legal needs.

While special-needs planning covers many of the same issues as conventional estate planning, it focuses on those with disabilities. Because of this focus, planning involves ensuring the beneficiary’s unique medical and financial needs are fully met to maximize quality of life. And special-needs planning is not limited to minor children. Anyone, no matter their age, who faces disability issues should consider special-needs planning.

A few of the areas covered under special-needs planning include:

Finances: What funding is available to make sure the financial needs of your loved one are met?

Compliance: Do all of the provisions put together to protect your special needs loved one comply with governmental requirements?

Benefits: Is your loved one receiving all the benefits to which they are entitled, for example Supplemental Security Income (SSI) and Medicaid?

Special-needs planning is extremely complicated and vital. It is important at any time to consider this but especially now, during the month that is designated to raise awareness of this issue.
